Terms of Service

These Terms govern your use of Eternal Memorial, a life story preservation platform operated from Australia. Please read them carefully. By creating an account or using the service, you agree to these Terms.

1. Who we are

Eternal Memorial (“we”, “us”, “our”) provides a guided platform for creating, publishing and preserving life stories — both Living Legacy stories (preserved in life) and Memorial stories (in loving memory). We are based in Australia and the service is provided in Australian English.

2. Eligibility and accounts

You must be at least 18 years old to create an account. You are responsible for the security of your login credentials and for everything that happens under your account. Notify us promptly if you suspect unauthorised access.

3. Our products

Story Preservation is a one-time purchase of A$99 that publishes a story forever, with a permanent Story ID, permanent URL and permanent QR code. Preservation Plus is an optional annual subscription of A$29 that unlocks ongoing editing, family tributes, Legacy Messages and continued dashboard access. All payments are processed by Stripe; we do not store full card details on our systems.

4. Story Builder assistance

Eternal Memorial provides guided tools, automated systems and story-building technology designed to help organise memories, photographs, milestones and personal information into a structured life story.

While we aim to produce high-quality results, generated content may contain inaccuracies, omissions or formatting issues and should always be reviewed before publishing.

You remain responsible for the final content of your story.

5. Your content

You retain ownership of the photographs, words and memories you upload (“Your Content”). By using the service, you grant us a worldwide, royalty-free licence to host, store, back up, display and transmit Your Content solely for the purpose of operating and preserving your story. You confirm you have the right to upload anything you share and that Your Content does not infringe the rights of others.

6. Memorial stories and consent

When you create a Memorial for a person who has passed away, you confirm that you have a legitimate connection to that person and the authority to share their story. If a family member raises a reasonable objection, we may pause or remove a story while the matter is resolved.

7. Story Guardians

You may invite trusted people as Story Guardians to help care for a story over time. Guardians act on your behalf within the permissions you grant. You remain responsible for choosing Guardians appropriately.

8. Permanence and preservation

We are committed to preserving published stories for the long term through redundant infrastructure, daily backups and ongoing platform maintenance. While no online service can guarantee perpetual operation under every circumstance, preservation is a core purpose of Eternal Memorial and we design the platform accordingly. Our Data Preservation Promise sets out the technical and operational commitments behind this.

9. Acceptable use

You agree not to use Eternal Memorial to publish unlawful, defamatory, harassing, hateful or sexually explicit material, or to impersonate another person. Full details are in our Acceptable Use Policy.

10. Fees, refunds and cancellation

Story Preservation is a one-time fee. Preservation Plus is billed annually and may be cancelled at any time from your dashboard; cancellation takes effect at the end of the current billing period. Refunds are handled under our Refund Policy, in addition to any rights you have under the Australian Consumer Law.

11. Beta service

Eternal Memorial is currently in beta. Features may change, and occasional issues may occur. We will communicate clearly about anything that affects your story.

12. Disclaimers and liability

To the maximum extent permitted by law, the service is provided “as is”. Nothing in these Terms excludes consumer guarantees that cannot lawfully be excluded. Our aggregate liability to you is limited to the fees you have paid us in the 12 months before the event giving rise to the claim.

13. Suspension and termination

We may suspend or terminate an account that materially breaches these Terms. Where possible we will give you a chance to put things right first. If we terminate without cause, we will use reasonable efforts to preserve published stories in line with our Data Preservation Promise.

14. Changes

We may update these Terms from time to time. Material changes will be communicated by email or via the dashboard before they take effect.

15. Governing law

These Terms are governed by the laws of Queensland, Australia. The courts of Queensland have non-exclusive jurisdiction over any dispute.
